ONLINE LABOR CONTRACTS

All the evidences issued by ANF Certification Authority through this online contract service have legal value. All of them are authenticated by ANF Certification Authority by means of electronic signature/seal, comparable to the handwritten signature. Regarding the signature of the contract by the worker, it must be taken into account:

• Worker with electronic certificate

  ANF Certification Authority checks in real time if the worker uses a QSCD device in the elaboration of his signature, so the resulting signature will be comparable to the handwritten one (eSignature) or, if it is an advanced electronic signature. The platform will accept or deny the contract according to the legal policy of the organization.
  
  

Worker without electronic certificate

ANF Certification Authority follows the procedure of generating session keys and sending them to the devices in possession of the employee(SMS, eMAIL, WhatsApp). With these keys, the employee agrees to receive the contract, accredits its opening, and confirms its acceptance. In addition, he/she is required to stamp his/her personal signature using the electronic board of his/her cell phone, tablet or touch screen of his/her terminal, or electronic pen (including mouse).The activation of the Web cam is facilitated to proceed to the recording of the process.

All this is registered and authenticated by ANF Certification Authority.

In no case are biometric data collected (behavioral or identified image) that concur with the data protection legislation (RGPD-LOPD).

In any of the cases, ANF Certification Authority proceeds to stamp electronic time stamp, performs verification of certificate validity status by obtaining OCSP response from the issuer of origin, and generates validation certificate.

Global cost of the service in any of the assumptions 0.75 euros / contract.

IMPORTANT NOTICE
In the case of evidences that are not electronic signature, that is to say, that have been obtained from workers that elaborate advanced electronic signature or that do not have certificate, the evidences are indirect and, therefore, subject to the criterion of interpretation of the Judge.
